What is Workers Compensation?

WorkCover is a highly regulated, compulsory insurance scheme which provides workers with access to insurance cover if they are injured either at work or in the course of work. The aim of WorkCover Queensland is to get the injured worker back to work as soon as possible.

Worker’s compensation is a no-fault scheme. This means the worker does not have to prove that anyone was at- fault or negligent. However, if the worker was injured as a result of the negligence of either their employer or another worker, then the worker may be able to be compensated for their damages. Thus, the worker may be able to pursue a damages’ claim in addition to their compensation claim.

WorkCover Queensland will assess the worker’s injury and provide, at no expense to the worker, access to rehabilitation and treatment that WorkCover deems appropriate. WorkCover will also decide the length and intensity of the treatment. The injured worker may also be compensated for lost wages.
If the worker has sustained a permanent injury, WorkCover will organise for the assessment of the impairment and, if appropriate, a lump sum offer may be made to the worker. The worker is under no obligation to accept this offer.
